How Do Bail Bonds Work?
A bail bond, also called a surety bond, is typically arranged when a friend, family member, attorney, or the defendant contacts a bail bond company. During the first call, the agent gathers basic details—where the person is being held, the charges, employment, residence history, and other information used to assess risk.
If the customer moves forward, they’ll sign the required paperwork, including the bail bond application, indemnity agreement, and receipt. Once finalized, a licensed agent posts the bond at the jail, leading to the defendant’s release. A reliable bail bond company can usually complete the process within 1–2 hours, though it can’t begin until booking is complete.
By law, the fee is usually 10% of the total bail amount, and EZ1 Bail Bonds offers payment options to help meet your needs. Be cautious of companies offering rates below the legal minimum—these offers often violate Michigan law or serve as bait‑and‑switch tactics.
Because family, friends, and sometimes collateral are involved, bail bond companies can be confident the defendant will appear in court. If someone skips bail, the agent has the right and responsibility to locate the defendant and return them.
Always understand your responsibility as an indemnitor before signing. If the person misses court, the bail bond company will expect your help in locating and returning them.
Arrest and Booking Information
When someone is arrested, they’re taken to a local law enforcement facility for booking, where bail is set if eligible. The booking process includes fingerprinting, background and warrant checks, entering information into the system, and securing personal belongings. During this time, the detainee won’t have access to phones, money, or personal items.
Once fingerprints are taken, the individual is moved to a cell. Phone access varies by jail—some allow calls before placement, while others allow them only when staff is available.
Processing an arrestee can take anywhere from under an hour to several hours, depending on the jail’s size, workload, and how quickly the system updates. Only after this process is complete can release options, including bail, move forward.
Options for Release
There are four main options for release after someone is booked into jail:
1. Bail Bond (Surety Bond)
A bail bond allows a licensed bail agent to post bail on the defendant’s behalf for a fee, typically 10% of the total bail.
2. Personal Recognizance (PR)
For lower‑level charges, a judge may release a defendant on their own promise to appear in court. No money is required, but only a judge can grant PR release.
3. Cash Bail
The full bail amount is paid directly to the court in cash or cashier’s check. Funds must come from a legal source, and the entire amount is refunded once the case is resolved. This option works best for lower bail amounts or when someone can afford to have funds held for a long period.
4. Citation Release (“Cite Out”)
For minor offenses—often traffic violations—officers may issue a citation instead of booking the individual. The citation requires the person to appear in court on a scheduled date.
Release From Jail
The jail release process can be likened to the booking process in reverse. Unfortunately for the detainee and the waiting family, it is not like checking out of a hotel where an accounting is presented and paid and you go on your way.
Regardless of the release option employed, the computer system must be updated, the detainee is brought from the cell, personal belongings are collected and accounted for and the individual receives paperwork explaining the charges and where and when to appear.
